Ballarat’s First Drug Court Graduate

This month, our office had the great pleasure of attending the Drug Court graduation of Philip Holt at the Ballarat Magistrates Court. It was easily the most rewarding and positive experience we’ve ever had in a Magistrates Court.

We had been assisting Philip for many years and were so pleased to see the enormous change the Drug Court had made in our clients’ lives.

Initially, we assisted Philip back in 2012; at the time, he had a long history of imprisonment, was homeless, had longstanding addictions and children with whom he had limited contact, and, of course, was facing imprisonment again. In mid-2022, Philip was yet again remanded into custody for further offending. Our lawyer, Brooke Tamanika, spoke to Philip whilst he was in custody and explained to him the benefits of being placed on a DATO (Drug and Alcohol Treatment Order). Philip explained to Brooke that he was ‘sick of this life he was living and wanted to change’. Brooke appeared before Her Honour Torres and explained his circumstances and why he wanted to be placed on a DATO. Ms Torres accepted Brooke’s submissions, and he was lucky enough to get into the new Drug Court at the Ballarat Magistrates Court.

We are proud to say that at the end of his drug treatment order, he had stable housing, clean drug screens, was living with his family and had completed training so he could help others.

At the Drug Court graduation, Her Honour Torres and his whole support team spoke, and they paid tribute to Philip and everyone involved in helping him. Many people remarked on how bumpy his journey through the early times of the order, but that with perseverance from all involved, he’d gotten through.

It was great to see the summary crime system at its best and see what can be done if we invest in the right things – there were rounds of applause in Court at the end of his graduation, and plenty of happy tears were shed.

We are very thankful for this ‘innovative’ court service for people trapped in the cycle of drug-related re-offending.

If you are going to plead guilty in the Magistrates Court of Victoria or County Court of Victoria , you need to understand the significance of character reference letters for your Court proceedings. Facing Court for any legal matter can be overwhelming and stressful, so we have developed a guide for your referee to help you with your legal proceedings.

Your referee’s letter to the Court could make a substantial difference to the sentence that you are handed.

WHAT IS A CHARACTER REFERENCE?

A character reference is a letter (usually typed and signed) from a person of good character and reputation. It is a letter about the person facing Court, where an individual writes about the character, values, actions and emotions involved which may have led to the accused being prosecuted in Court.

When the Magistrate or Judge reads the reference, they seek a better understanding of who you are, which is beyond the charges you are facing. As someone who knows you personally, their perspective can provide invaluable context to the Court’s decision-making process. Typically, the best character references come from a family member, a close or long-term friend, or someone who has worked with you for a significant period.

HOW SHOULD A CHARACTER REFERENCE BE FORMATTED?

A character reference should be typed, dated, and signed with your full name, address and occupation. It should be addressed to “The Presiding Magistrate” or “The Presiding Judge” of the Court you have to go to.

Ideally, the reference should be no longer than one page. If the reference is composed in an official capacity, such as by an employer, it should be on letterhead and signed.

WHAT SHOULD YOUR REFEREE INCLUDE?

Keep in mind that the reference must stand by itself. The Court will not contact your referee for clarification; they will not need to speak in Court for your proceedings. The reference must show that your referee is aware of the specific charge you are facing in Court, for example, “I am aware that [name] has been charged with drug possession”.

They should explain the length and circumstances of their relationship with you and their opinion of you, for example, whether you are responsible, hardworking, or honest. It can be valuable to include any knowledge they have about any community involvement accompanied by any participation you have had in various clubs, groups, or volunteer organisations.

Your referee must remember that the Court sees many character references, and generalised positive statements will have little impact. Your reference must try to paint a realistic picture of your character with relevant examples and stories, such as a story illustrating your honesty. This is especially important if you are being charged with a dishonesty offence like theft, deception, or fraud.

If your referee is aware of personal circumstances that have contributed to the actions before the Court, they should refer to these. However, ensure that in covering these circumstances, your referee does not pass the blame onto others or imply that you are not responsible for your actions.

If your referee is your employer, they should clearly state how a conviction will, or may, affect your ability to do your job or continue in employment.

Before submitting the character reference, proofread it carefully to eliminate grammatical errors or inconsistencies. Ensure that the content aligns with your referee’s genuine observations and feelings.

WHAT SHOULDN’T BE INCLUDED IN YOUR REFERENCE?

Your referee shouldn’t include something that is not true. It is an offence to mislead the Court. We recommend the referee confirm any details with you or contact us for expert recommendations. They should enquire whether you have any prior criminal offences, especially of the same or similar nature.

They should not include their opinion of the merits of the law or the victim. Neither opinion is of interest to the Court.

Lastly, a referee should not make recommendations regarding the penalty that the Court should impose.

In Australia, the complexity of criminal law , especially when it comes to matters as delicate as domestic disputes, is often overwhelming for many. An Intervention Order (IVO) may be known as a domestic violence order (DVO), family violence intervention order (FIVO), protection order, family violence order (FVO) or a violence restraining order (VRO) in other states and territories, serve as a critical legal measure to safeguard individuals from further harm. But what exactly are these orders, and how do they function within the legal system? This post delves into the details, providing clarity on a subject often shrouded in confusion.

WHAT IS AN INTERVENTION ORDER?

An Intervention Order (also known as IVO) is an order made by a Magistrate at the Magistrates’ Court of Victoria to protect a person who has experienced some form of ‘family violence’. This may include physical, mental, sexual and emotional abuse, economic abuse, threats and other behaviour that causes a family member to fear for their safety and wellbeing.

Intervention Orders can be brought to the Court by our firm filing an application, by the affected family member (AFM), also known as the Applicant, or by the Police on the Applicant’s behalf. Applicants may also apply for Orders to be made on behalf of their child, also known as the protected person. The individual whom the Order is being made against is called the Respondent.

TYPES OF INTERVENTION ORDERS

FAMILY VIOLENCE INTERVENTION ORDERS

A Family Violence Intervention Order is a legal order issued by the Court to protect family members from family violence within the home. This type of Intervention Order is where the affected person must be a family member or relation of the Respondent or currently or have previously been in a relationship with the Respondent.

INTERIM ORDERS

If the affected person feels immediately threatened, they can apply for an Interim Intervention Order. These orders are made when the Court deems the affected person is in danger of harm and needs immediate protection. They are temporary orders that remain in place until the matter can be dealt with at the Court.

SAFE CONTACT ORDERS

Safe Contact Orders are limited IVOs that may only include conditions not to commit family violence and not to damage property. Typically, where the Court does not assess the risk of family violence as being high, and usually where the police are supportive, a Court may simply order a Safe Contact Order.

THE APPLICATION PROCESS

Applying for an IVO is a process that requires careful attention to detail. Here’s a general outline of how it typically unfolds:

Application Submission:
Our office can apply on your behalf; or
The victim can apply at the Magistrates Court; or
Victoria police can apply for protection on your behalf.
Court Hearing:
The Court will give the Applicant and Respondent a Court date; and
You will attend Court for the Application; and
The Magistrate will review the Application and listen to the parties.
Issuance of Order:
If the Magistrate deems the order necessary, they will order an Interim or Final IVO with specific conditions tailored to the situation.

UNDERSTANDING THE CONDITIONS

The conditions imposed on the Respondent can vary widely depending on the circumstances. Typical conditions may include:

Not to commit family violence
No contact with the AFM, either directly or indirectly
Staying away from certain locations, such as the AFM’s home or workplace
Surrendering weapons

THE IMPORTANCE OF COMPLIANCE

It is a criminal offence to disobey or breach an Intervention Order. If you do something prohibited by the Order, the Police may charge you with breaching the Order. The maximum penalty for breaching an order is 240 penalty units and/or up to 2 years imprisonment. There are more severe consequences for further breaches.

If you are Ordered not to contact the Applicant, it is still an offence to speak to them or see them even if they say they permit you to do so. We commonly see clients charged with breaching Intervention Orders by responding to phone calls or text messages sent by the Applicant themselves.

Whilst this may appear unfair, the Respondent must always abide by the conditions of the Order made by the Court.

BINDING FINANCIAL AGREEMENTS

A Binding Financial Agreement (‘BFA’) is a private agreement between the parties involved in a divorce or separation that outlines how their property will be divided. Unlike Consent Orders, BFAs do not need to be filed with the Court. However, they must still comply with certain legal requirements to be enforceable.

A BFA must be in writing, signed by both parties and witnessed by an independent lawyer to be valid. Before signing, each party must also receive independent legal advice about the agreement and its effect on their rights.

MAIN DIFFERENCES

One of the advantages of BFAs is that they are quicker and less expensive to obtain than Consent Orders. They can also cover various issues, including property settlement, parenting arrangements, and spousal maintenance. However, BFAs can be more difficult to enforce than Consent Orders, as the Court does not review them.

Another important difference between BFAs and Consent Orders is that BFAs can be set aside by the Court in certain circumstances, for example, if one party did not receive independent legal advice before signing the agreement or if the agreement was obtained by fraud, duress, or undue influence.

What is a Spent Conviction

A ‘spent conviction’ is a crime you were found guilty of at Court that won’t appear on most criminal record checks (police checks).

In December 2021, the Spent Convictions Act was enacted. Before this, a conviction would appear on every criminal record check, no matter where you were sentenced to, with or without conviction.

Criminal convictions can be huge barriers to getting a job, housing, or accessing services. Without a spent convictions scheme, criminal convictions could show up no matter how old they are. With the scheme, old convictions won’t appear on most police checks, and people can move on with their lives more easily.

There are three ways in which your conviction can become spent:

Immediately after being sentenced
After your conviction period has been finalised
On an application to the Court

Convictions that are immediately spent

Your conviction is spent on the day you are sentenced if:

You were found guilty, but it was recorded ‘without conviction’
You were found not guilty by reason of mental impairment, or you were found unfit to be tried
You were under 15 at the time you committed an offence
You were sentenced in the Children’s Court, and the only penalty was a fine
The conviction was for an infringement

If you were placed on a ‘without conviction good behaviour bond with conditions’, your conviction will be spent after you have completed and complied with your conditions and your sentence has been finalised.

Applying to the Magistrates Court to get your conviction spent

If your conviction is not eligible to become spent automatically after the conviction, you may be able to apply to the Magistrates’ Court for a spent conviction order. However, not everyone can apply for this order. You can only apply if:

You were given a ‘serious conviction’, and
The ‘conviction-free period’ has finished

AND one of the following is true for you:

You were a child or young offender when the conviction was given, or
you were an adult (or found guilty in an adult court) convicted of a sexual offence or serious violence offence, and no term of imprisonment was imposed, or
you were an adult (or found guilty in an adult court) and were sentenced to under five years imprisonment.

What is a ‘serious conviction’

A ‘serious conviction’ is considered too serious to be spent automatically after the conviction-free period.

A ‘serious conviction’ is when you are:

sentenced to more than 30 months of imprisonment or detention; or
found guilty of a sexual offence; or
found guilty of a serious violence offence.

The conviction-free period for a serious conviction is the same as other convictions:

Five years for children
Ten years for adults

When applying to the Court, the Court may consider the following:

the nature, circumstance and seriousness of the offence
the impact on any victims of the offence
your personal circumstances
factors of incarceration and specific impacts if you are Aboriginal or Torres Strait Islander, your age and maturity at the time of the offence
any rehabilitation you have done
any risk to public safety in making the order
any other relevant matters

When can a spent conviction be disclosed

There are three areas where your spent conviction may be disclosed:

Police checks for some jobs
In legal proceedings
Information sharing

Police Checks

Some employers and licensing ®gulating bodies are still allowed to see your spent convictions. However, they can only have your spent conviction information for specific purposes.

If you are applying for a job, a license, or other accreditation with these places and they require a police check, your spent conviction will show up. For example, if you are applying for a Working with Children’s Check, you will need to submit a police check; they are allowed to see your spent convictions for the purpose of assessing your eligibility for working with children.

Other industries in which spent convictions may be disclosed can include:

Working, volunteering or providing care for children
Health practitioner registration
Commercial vehicle driver or owner accreditation
Jobs with Corrections Victoria
Jobs with Court Services Victoria
Disability workers
Public transport drivers
Jobs with the Independent Broad-based Anti-Corruption Commission
Jobs with the Office of the Victorian Information Commissioner
Boxing and combat sport licenses
Registration as a marriage celebrant
Immigration matters
Licenses to grow and process poppy plants
Appointments of honorary justices
Firearms licenses
Gambling licenses
Registration as a teacher
Admission as a lawyer
